Right of withdrawal for customers from Austria
Right of withdrawal
If the customer is a consumer (Section 1 Paragraph 1 Number 2 KSchG), he can withdraw from the contract within a period of 14 days without giving reasons. It is sufficient if the declaration of withdrawal or the contractual item is sent within this period. The withdrawal period begins on the day on which the consumer or a third party named by the consumer who is not the carrier acquires possession of the goods. The revocation must be sent to:
Quantum Power GmbH
Gatterburggasse 23/3, 1190 Vienna
T: +43 (1) 3671211
Email: info@quantum-power.at
Consequences of withdrawal
In the event of an effective withdrawal, the seller has to reimburse the payments made by the customer step by step and to reimburse the necessary and useful effort made by the customer. The customer must postpone the services received and pay the seller a reasonable fee for their use, including compensation for a related reduction in the fair value of the service, as well as for use that goes beyond checking the properties and functionality. In the event of withdrawal, the customer bears the costs of the return. If the customer is an entrepreneur according to § 1 UGB, a revocation is completely excluded.
